EADS initially won the contract, but it was overturned after protests from rival Boeing and a Congress investigation which found flaws in the selection process. The competition was reopened in the summer, putting Boeing back in contention.

The Pentagon was then expected to restart the competition in September but US defence secretary Robert Gates said the Pentagon could not complete a fair contest before the presidential elections on November 4.
